Delay Claims in Construction
Delay claims arise when a construction project or work package is completed later than contractually required due to events that are not the contractor's or subcontractor's responsibility. Under NEC contracts, delay is addressed through the compensation event mechanism; under FIDIC, through the extension of time provisions. The financial consequences of delay – prolongation costs, increased preliminaries, loss of productivity and sometimes liquidated damages – can be very significant.
